Service Nature and Ownership of Intellectual Property
-Brain Case operates as a contract research and manufacturing service provider specializing in gene delivery systems and viral vector engineering. We manufacture vectors strictly based on customer-provided designs or instructions. Unless otherwise agreed in writing, Brain Case does not claim ownership of customer-designed constructs, nor does it transfer any intellectual property owned by Brain Case or third parties to the customer.
-All vectors are produced according to customer specifications, with full ownership of constructs and resulting intellectual property remaining with the customer.
Confidentiality of Customer Materials and Sequences
-All non-standard sequences, plasmids, vector designs, and related information provided by the customer shall be treated as confidential. Brain Case will not disclose or share such information with any third party without prior written consent from the customer.
Ownership of Research Outcomes and Data
-All data, results, discoveries, and inventions generated by the customer through the use of Brain Case products or services shall belong solely to the customer, unless otherwise specified in a separate written agreement.
Standard Components and Platform Resources
-Vector designs composed solely of Brain Case standard components (e.g., common promoters, backbone vectors, optimized expression elements) may be incorporated into Brain Case’s internal design repertoire and reused for other customers, provided that no customer-specific proprietary sequences or confidential information are involved.
Data Analytics and Statistical Use
-Brain Case reserves the right to collect and analyze anonymized statistical data generated during vector design and production (e.g., vector categories, success rates). Such data may be used for internal optimization or publication, provided that all identifying and proprietary information is removed.
Restrictions on Product Use
-Products provided by Brain Case are intended for use by the purchasing customer only.
-Any redistribution, transfer, or resale to third parties may require prior written authorization from Brain Case.
Brain Case Proprietary Technologies and IP
-Brain Case retains all intellectual property rights related to its proprietary gene delivery systems, vector engineering strategies, packaging processes, cell platforms, and associated technologies, including patents, know-how, and trade secrets. These technologies are developed and continuously optimized by the scientific team led by co-founders Dr. Fuqiang Xu and Mr. Weiwei Feng.
-Customers are expected to respect the proprietary nature of these technologies. Any reverse engineering, replication, or commercial use requires prior authorization from Brain Case.
Third-Party Intellectual Property
-Some vector components may involve third-party intellectual property (e.g., promoters, regulatory elements, gene sequences).
-We recommend that customers confirm appropriate licensing for their intended applications. Brain Case does not grant rights to third-party intellectual property.
Scope of Use
-Unless otherwise specified, all products provided by Brain Case are for Research Use Only. Customers intending to use the products for commercial development, clinical applications, or regulatory submissions must ensure compliance with all applicable laws and licensing requirements.
